The Fan-led Review of Football Governance, chaired by Tracey Crouch MP, was published this evening.

Included in the Report are recommendations for a Golden Share.

Football clubs are a vital part of their local communities, in recognition of this there should be additional protection for key items of club heritage.

It should be a licence condition that all licenced clubs should include within their articles of association a Golden Share requiring democratic consent to proposed actions relating to identified heritage items.

The consent of the holder of the Golden Share should be required for the sale of the club stadium, relocation outside of the local area which is not a temporary part of a redevelopment, joining a new competition that is not approved by FIFA, UEFA and the FA and/or leaving a competition in which it currently plays, club badge, first team home colours, and club playing name.

The Golden Share should be held by a Community Benefit Society formed for the benefit of the club’s supporters operating under standardised rules set by IREF in conjunction with the FCA.

Seventy three League clubs currently have a CBS in the form of a Supporters’ Trust. It should be open to existing Supporters’ Trusts to be the Golden Shareholder, provided that they adopt and operate according to the standardised IREF rules.

And that supporter was escorted by police from the tube to the meeting, was not allowed to stand during meetings, couldn’t drink alcohol in site of the meeting table. When the meeting finished he was held in the room until the other participants had left them escorted by police to the station, only to find the last train went an hour earlier.

To be fair, it really doesnt matter who is on the panel, the reviews recommdations are very good. The acid test is if and how they are implemented and when. The Premier League will hate it (their response is hard evidence of this, woolly and non committal). This will lead to a lot of 'cherry picking' to give the illusion of 'working with/towards' etc. but, for me, it is when something is forced upon them I can hear them squeal. That would be progress.

Lsitening to the reaction from Football this morning, I think the government are going to have to ram this through if they are serious. They will be fought every step of the way.

The EFL breaking ranks with with Premier League and FA and coming out in support of an independent regulator is a big thing. The FA is seen as completely out of touch and full of blazers and the Premier League as too greedy.

Some of this is all very noble and all that, but how do the government think they can implement this against privately owned company's or in the case of the other Untied a PLC.

The 162-page report, written by Tracey Crouch MP with the assistance of an expert panel, calls for the formation of an independent regulator for English football with powers that would extend to seizing control of a club from their owner.

All companies are subject to UK law.
The government would argue that this is a case of market failure which a regulator is needed to correct.

Ia gree they ave got a fight on their hands though.

Thats why they are the 'government' they can pass laws and legislation that everyone has to follow including football clubs, owners and companies. Setting up an independent regulator is not uncommon. The utilities have have them, financial institutions etc. etc. How powerful they are depends on the rights afforded them. Football clubs, if the government wishes to enact, don't have a say.

We have a regulator in finance, we have a media regulator, this is a no brainer. This needs professional finance, legal and sporting hands on expertise at the highest level. There should be a heritage and community committee, but it should not be on the main board or you risk a totally adversarial relationship and nothing will get done.

So we let the Civil Servants, most of who couldn't run a bath, take over the running of PL football club. No thanks I'm oot, would make our lot look credible.

That's not how it works. The FCA is the bank/financial sector regulator empowered by law, so with the power of life and death over banks. It is nothing to do with the civil service and is run and operated by professionals mostly from the legal and financial sector. It is not tax payer funded either, there is a levy charged across the banking and finance industry that pays for the FCA, whose offices actually over look the LS.
The PL would be forced by law to pay for its own independent regulator......sweet that is.

Further, in terms of how effective is this sort of oversight arrangement - Many businesses who had to shut up shop during covid had "business interruption insurance" and put in claims, the insurance industry mugged them off, 100's of '000's of businesses. The FCA looked at this, saw that insurers were just waiting out companies going bust not to pay, including not paying when policies had specific disease cover. They stepped in, even though they had limited regulatory powers over the insurance industry with a legal test case and took almost the entire insurance industry to court in a "proving" case. They won, and laid down some guidelines re-payment and timing of claims, via which 100's of '000's of companies are now receiving payment of their claims, my own included, and this is not for small money, over all its billions which the insurance companies would have just kept. The insurance business has more money down the back of the sofa than football will ever generate, the regulator smashed the granny out of them. One of the Supreme Court Law Lords said of the insurance industry practice "You are not offering insurance cover, merely the appearance of it" in sumation of their judgement after the final appeal.
That's why the PL are ****ting themselves, a professional regulator will improve football immeasurably at all levels and there will be jack **** the PL will be able to do about it. Cant wait.
