Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

While the Kabba situation is very damming for SU not least exposing their rank hypocrisy I thought they were unlikely to ever have to answer for it as the PL had already said it would not press charges in this case (possibly because SU were relegated out the PL by then) can anyone enlighten me othe...

Re: West Ham Utd v Fulham: Match Thread

okay. I'm bumping this thread because unfortunately this forum has become a reflection of football today -- that is, 140 plus pages of Kia, Sheff Utd etc and four pages on the match tomorrow. I'm going tomorrow. I'm dragging my hubbie with me. And I still don't have the name of a decent pub to drin...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

Half a mo'. Do the words 'fact' and 'opinion' mean different things down there? You know as much about the FACTS as I do, everything on here is opinion unless one of the tribunal or key witnesses is actually posting...and I wouldn't believe the witnesses. :D Tevez played in 27 games and didn't scor...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

I speak as a supporter of a club who once lent Peter Withe to another club and he scored against us. Kabba played against us for Blackpool this season. The '3rd party influence' was a story written by the talking buttock as an attempt to muddy the water, and has no bearing on this case as it wasn't...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

tonycurrie. Calm down mate, Most West Ham supporters are not proud of what our club did. Whether you agree with it or not we were punished with a fine, not a points deduction that would have relegated us. Now after 3 previous panels have not gone his way, McCabe's has got lucky this time. We were fo...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

Somewhere amongst Sheff Utd's figure for compensation is a claim for bonus's to players for gaining promotion. But they didn't last season, so reading that if at anytime in the future they did win promotion, West Ham would have to pay those player bonuses! I could see a further claim coming in from ...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

westhamonline seem to have printed the full judgment. Lots of detail regarding the signing of the Argentinians which I thought we had already been punished for. Eggy was looking to sell Tevez because of his wages and his lack of contribution in the January tranfer window. By the summer he had change...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

If we can't go to CAS with this and try and take it to a civil court would we lose F.A. recognition, could we be threatened with expulsion from the Premier League, well any English league. Maybe we should start our own breakaway league and invite Man U, Arsenal, Liverpool, Chelsea and Man City, well...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

I know commonsense tells me West Ham have a decent case to appeal. What concerns me is if it is thrown out in the manner of Lewis Hamilton and the FIA when after two days of taking evidence they then decided there was no right to appeal in the first place. I've always known the law and common sense ...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

Well done Hammermaff. i wonder how the Mail got hold of that? Who could have gave it to them? After reading all that is it me but don't the panel contradict themselves repeatedely, especially when commenting on the last 2 games, then over the last 9 games then use Sheff Utd gaining 38 points ...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

"But hold on a minute, the fact is West Ham didn't honour that verbal agreement if it existed" But that's not the point. West Ham assured the PL that no agreement of any any kind any longer existed with Kia. Whether we acted on it or not is irrelevant. It's like saying "yeah I know I...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

Only the most one eyed of West Ham supporters or a credulous idiot would think that Kia's current position with the club has nothing to do with settling old payments. The tribunal board members are neither, and there's no reason to think CAS would be any different. The only current defence as I see...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

But we tore up the offending TPA unilaterally, we told the Premier League and MSI this and putting it in writing. The Premier League accepted this MSI didn't. Now Kia's lawyer has said that through Duxbury that a verbal agreement was made that we would honour the TPA. So it seems one person word aga...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

I'm not 100% on this, but surely they only paid us for his registration, we didn't actually own him, he WAS & still IS owned legally by a 3rd party. It was just to release his registration, Tevez is still owned by a 3rd party. West Ham do not come up smelling of roses over this but peopl...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

Love the irony of an FA official telling us we should get on with it and respect the judgement. I saw Lord Treisman on ssn saying that West Ham should just accept the decision, the fact that Sheff Utd haven't accepted two previous decisions that they weren't happy with didn't seem to come into his ...

Re: Kia, Sheff Utd, Duxbury, McCabe and arbitration

Im sure that West Ham unilaterally tore up the offending part of the contract just before the Wigan game and it was stated at the time that Kia/MSI hadn't necessarily had to agree with it so long as West Ham were willing to contest there position in court. The Premier League were o.k. with this at t...

Tevez is now playing for Man U on loan and is still owned by a 3rd party but is a registered Man U player.

The only difference is the wording of the contract.
